Indianapolis Colts linebacker Josh McNary has been charged with rape in a criminal complaint filed Wednesday by prosecutors.
McNary, 26, is accused of sexually assaulting a 29-year-old woman in the early morning hours of Dec. 1. He is charged with one count of rape, one count of criminal confinement and one count of battery, according to the complaint obtained by Sports Illustrated.
The alleged victim told Indianapolis police that a man took her to an apartment after she had been out drinking with friends following work, according to documents filed with the court.
The man tried to kiss the woman and when she rebuffed his advances, the two fought before he sexually assaulted her, according to the documents. After the incident, the victim told police, she left the residence with the man’s cellphone.
Police used that phone to identify McNary as the suspect, the documents indicated.
According to the Associated Press, the Colts have stated that they’re aware of the allegations.
The AP also said that police reported that when they arrived at McNary’s apartment to investigate, the player claimed to have preserved evidence because he expected officers would be coming.
McNary played for Army and signed with the Colts as an undrafted free agent in 2013.
The Colts play the New England Patriots in the AFC championship game on Sunday.
