Man Crossing Tustin Street Is Hit, Dies

A man using a crosswalk to walk across Jamboree Road in Tustin was struck and killed by a car Friday night.
The man, David F. Guerrero, 63, was rushed to Western Medical Center-Santa Ana after the accident. He was pronounced dead, due to internal injuries, at 9:15 p.m., according to Tustin police.
The accident is under investigation, Police Lt. Christine George said.
About 6:20 p.m. Friday, Guerrero was walking along West Drive, then tried to cross Jamboree Road. While in the crosswalk, he was hit by a car. The driver, Christopher L. Webb, 18, of Irvine, had been driving on West Drive and was turning to head south on Jamboree.
Webb had not been charged by Saturday afternoon, George said.
Under California law, pedestrians often have the right of way if they are using crosswalks to cross the street. But they still have to follow the rules, George said. Police will interview witnesses this week to determine, for example, whether Guerrero was crossing with the traffic signal.
“Some culpability could conceivably fall with the pedestrian, even though they are in a crosswalk,” George said.
