Court OKs Right to Sue for Grandchild Visits

ALBANY, N.Y. — The state’s highest court ruled Monday that grandparents may sue to visit their grandchildren even when the children’s mother and father are married and are considered good parents.
Before the 6-0 Court of Appeals ruling, grandparents were allowed to seek court-ordered visits only if the child’s parents were dead, divorced or unfit.
The case involved a child identified in court papers as Max, whose parents and maternal grandparents had a falling-out when the boy was an infant.
