A federal jury has awarded nearly $9 million to a woman, saying G. D. Searle & Co. was negligent in testing the Copper-7 intrauterine device and misrepresented it, thus contributing to the woman’s sterility. The jury awarded Esther Kociemba, 30, of Elk River, Minn., $7 million in punitive damages, $1 million for emotional distress and $750,000 for pain and disability. Searle said it will appeal the decision. Jurors also concluded that the Skokie, Ill.-based Searle was not negligent in its design or manufacture of the Copper-7 worn by Kociemba.
